Unfortunately, many divorcing couples cannot agree on a custody and parenting plan for their children. When that happens, the court often appoints someone to represent the interests of the children. By appointing either an attorney for the minor children (AMC) or a guardian ad litem (GAL), the court hopes to shield the children from the process while still addressing their individualized needs and wants.As their legal representative, our obligation as a GAL or AMC is exclusively to your child or children, with whom we work to establish a trusting relationship. We meet with and communicate regularly with you and your spouse (or former spouse) to gather information and hear your concerns. We talk to professionals and other individuals who are familiar with your family. If we are the GAL, we then make recommendations to the court for custody or a parenting plan that we believe is in the child's best interests based on everything we have learned. If we are your child's attorney, we will advocate for their interests and their wishes with your lawyers and to the court. Unless you reach an agreement, the final decision on these matters will always rest with a judge. |
